Are magic mushrooms legal in Texas?
No, and Texas is one of the strictest states. Possessing any amount of psilocybin, even under a gram, is a felony. The state's 2021 psilocybin study law has expired, and its 2025 psychedelic investment went to ibogaine, not mushrooms. No Texas city has decriminalized it.

The short answer
Psilocybin is illegal in Texas, and possession of any amount is a felony. Under a gram is a state jail felony, and the charge climbs to higher-degree felonies as the weight goes up. Because mushrooms are weighed whole, a modest bag of dried mushrooms can cross those thresholds quickly. No Texas city, including Austin, Dallas and Houston, has a decriminalization or lowest-priority measure.
If you're in Texas, the realistic legal options are clinical trials or travel to Colorado or Oregon. For a wider view of how other states compare, My Mushroom Dispensary keeps a state-by-state psilocybin legality guide alongside our own 50-state tracker.
What Texas has done on psychedelics
- HB 1802 (2021) ordered a state study of psilocybin, MDMA and ketamine for veterans with PTSD. That law expired on September 1, 2025.
- SB 2308 (2025), signed June 11, 2025, created a program offering up to $50 million in matching funds for FDA trials of ibogaine, a different psychedelic studied for opioid addiction. It does nothing for psilocybin.
- Texas law generally follows federal rescheduling: if the DEA reschedules an FDA-approved psilocybin medicine, the state's schedules change to match 30 days after the federal order is published, unless the state health commissioner objects (Health and Safety Code 481.034).
Legal options for Texans
- Colorado: adults 21+ from any state can use licensed healing centers, and personal possession and growing are legal there. See our Colorado guide. Don't bring any back: crossing into Texas with psilocybin is a felony here, and transporting it across state lines can be a federal crime.
- Oregon: supervised sessions at licensed service centers. See our Oregon guide.
- Clinical trials: Texas research centers take part in psychedelic research, including a Defense Department-funded MDMA study at UT Health San Antonio. Search ClinicalTrials.gov for recruiting psilocybin studies; our therapy near me guide shows how.
"Mushroom" products in Texas stores
Gummies and chocolates sold as "mushroom" products in Texas smoke shops usually contain Amanita muscaria or other substances, not psilocybin. Some have made people seriously ill. Read about fake mushroom products before buying.
Frequently asked questions
Is psilocybin decriminalized anywhere in Texas?
No. No Texas city or county has passed a psilocybin decriminalization or lowest-priority measure, and state law makes possession of any amount a felony.
What is the penalty for magic mushrooms in Texas?
Possessing less than a gram is a state jail felony, and larger amounts are charged as higher-degree felonies. Weight usually includes the whole mushroom, not just the psilocybin. For your own case, talk to a licensed Texas attorney.
Did Texas legalize psychedelics for veterans?
No. A 2021 law funded a study of psilocybin and other drugs for veterans with PTSD, and it expired in 2025. A 2025 law funds FDA trials of ibogaine. Neither legalizes psilocybin for anyone.
