Magic mushrooms in Los Angeles: what's legal in 2026
Psilocybin is illegal in Los Angeles. California never legalized it, and unlike Oakland or San Francisco, neither the City nor the County of Los Angeles has made it a low police priority. That hasn't stopped a busy gray market, which is exactly why knowing the law and the product risks matters here.

Are magic mushrooms legal in Los Angeles?
No. Under California law, possessing psilocybin mushrooms is a misdemeanor punishable by up to a year in county jail, and selling them is a felony. Federal law treats psilocybin as a Schedule I drug everywhere.
California came close to changing that. In 2023 the Legislature passed SB 58, which would have decriminalized possession of natural psychedelics, but Gov. Gavin Newsom vetoed it in October 2023. Since then the state has only funded or sped up research. Seven California cities have passed lowest-priority resolutions (Oakland, Santa Cruz, Arcata, San Francisco, Berkeley, Eureka and Nevada City), but Los Angeles and Los Angeles County are not among them.
Plenty of Angelenos order online anyway, which remains illegal under state and federal law. If you go that route, the local option we know best offers same-day magic mushroom delivery in Los Angeles from a courier based in the San Fernando Valley.

LA's mushroom gray market
In Los Angeles, psilocybin products have been sold openly in some cannabis dispensaries, smoke shops and pop-up events, despite being illegal. Local outlets including Los Angeles magazine have reported on mushroom gummies and chocolates on dispensary shelves. Buying from a storefront doesn't make it legal, and it doesn't tell you what's in the package.
That second point is the bigger risk. In December 2025 the California Department of Public Health warned consumers not to eat TRE House brand "magic mushroom" gummies, chocolates and syrups after testing found synthetic compounds, 4-AcO-DMT and 4-AcO-DET, rather than natural psilocybin. Nationally, a 2024 outbreak tied to Diamond Shruumz products sickened people in dozens of states. Read our guide to fake and mislabeled mushroom products before you trust a label.
What California has done instead of legalizing
- SB 58 (2023): decriminalization bill, vetoed October 7, 2023.
- AB 1103 (2025): signed October 10, 2025, it speeds up state review of psychedelic research proposals.
- AB 113 (2026): the state budget, signed September 18, 2026, includes $4.7 million for veterans psychedelic-assisted therapy research. It legalizes nothing. Read the story.
- Ballot: no psilocybin measure is on California's November 2026 ballot.

Legal ways to take psilocybin from LA
- Oregon service centers. Adults 21+ from any state can take psilocybin at a licensed center with a trained facilitator. A 2026 study put the median price at about $1,900. See our Oregon guide.
- Colorado healing centers. Colorado licenses healing centers and also lets adults 21+ possess, grow and share psilocybin. See our Colorado guide.
- Clinical trials. Search ClinicalTrials.gov for recruiting psilocybin studies in Southern California. Our therapy near me guide explains how.

Frequently asked questions
Are shrooms decriminalized in Los Angeles?
No. Neither the City of Los Angeles nor Los Angeles County has passed a decriminalization or lowest-priority measure. Possession is a misdemeanor under California law. The California cities with deprioritization resolutions are Oakland, Santa Cruz, Arcata, San Francisco, Berkeley, Eureka and Nevada City.
Are the mushroom dispensaries in LA legal?
No. California has no license for selling psilocybin, so any store selling it is operating illegally, even if it also holds a cannabis license. Some products sold as "mushrooms" contain Amanita muscaria or synthetic compounds instead; California's health department warned about one LA-sold brand in December 2025.
Will California legalize psilocybin soon?
Not in 2026. The governor vetoed decriminalization in 2023, and there's no psilocybin measure on the November 2026 ballot. The state is funding veterans research instead. A federally approved psilocybin medicine, if the FDA approves one, would come through clinics, not stores.
What's the closest legal psilocybin to Los Angeles?
Oregon and Colorado. Both let adults 21 and older from other states take psilocybin at licensed centers. Oregon sessions must happen on site at a licensed service center; Colorado also allows personal possession and home growing for adults 21+.
